Need help with a myspace music situation...?

i have a artist account on myspace....fisrt off id like to know if its illeagle to use the background music from a ra song u know like the instrumental?...well anyway i made a song a few months ago with a friend and i used a rappers instrumental and my words and i try to upload it on myspace and it says its copy writed...? any one know anything abhis or how i can change the mp3 file so it isnt copy righted anymore...? plz i would appriciate it
